Judge slashes $450M from $1B Apple v. Samsung verdict, calls for a second trial

Judge Lucy Koh has significantly reduced the damages awarded to Apple in the major Apple v. Samsung patent trial, knocking off $450 million from the $1.05 billion award and saying Samsung should get a second trial.

Judge Lucy Koh has significantly reduced the damages awarded to Apple in the major Apple v. Samsung patent trial, knocking off $450 million from the $1.05 billion award and saying Samsung should get a second trial.

Apple won the Apple v. Samsung trial back in August, but as with many things legal, the stakes have changed during the past few months. Apple had requested to increase the jury’s award by $700 million in September. In December, Koh eventually called for “global peace” between the two companies.

But it looks like that won’t happen any time soon. Koh rejected Apple’s request to increase damages and indicated that the jury was not going to accept either party’s damage estimates. So she lowered the total damages by $450.5 million and said that portion of the damages would be judged in a second trial on a different set of products.

The new trial will evaluate the infringement claims concerning its Galaxy Prevail and 13 other smartphones. The devices, according to FOSS Patents, include:

Galaxy Prevail, Gem, Indulge, Infuse 4G, Galaxy SII (AT&T), Captivate, Continuum, Droid Charge, Epic 4G, Exhibit 4G, Galaxy Tab, Nexus S 4G, Replenish, and Transform

The jury’s damage findings on 14 other products will hold and will cost Samsung $599 million.

Koh suggested that both companies should seek a review of her order by an appeals court before there is a new trial.
